TERMS & CONDITIONS KEY MEMBERS

The Key Members Loyalty Program of Nude Project ("Loyalty Program"), is a loyalty program offered at the sole discretion of "Nude Project SL", a Spanish company with registered office at C/Pujades 81, 08005, Barcelona, Spain, provided with NIF  B01945328 to its customers who make purchases through the website (https://nude-project.com/) and/or its stores. 

Under the Loyalty Program, Nude Project will offer benefits and rewards, in accordance with this document of terms and conditions (hereinafter "Terms and Conditions"), which constitute the agreement between you ("Member") and Nude Project with respect to the Loyalty Program since its acceptance.

Membership of the Loyalty Program is limited to individuals and to one account per customer. Membership is not available to corporations, businesses, charities, partnerships, companies, or any entity (unless prior written approval is obtained from Nude Project) other than individuals of legal age.

To join the Loyalty Program, Members must have a customer account which can be created through the following link https://nude-project.com/account/login or in our physical Nude Project stores. By joining the Loyalty Program, Members agree to have read, understood and agree to be bound by these Terms and Conditions. These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services. 

Members must provide accurate and complete information when creating an account. Nude Project reserves the right to refuse membership to any customer who does not follow the enrollment procedures. Users must immediately inform Nude Project of any changes to their personal account information, such as name, address, phone number(s), and/or email address, by visiting the website https://nude-project.com/account and updating their user account. Any information obtained will be processed according to our Privacy Policy. 

The membership to the Loyalty Program is personal and non-transferable, and its transfer, loan, or sale is not permitted. Its use for any purposes other than those defined by Nude Project in these Terms and Conditions is also prohibited.

Nude Project reserves the right to suspend or cancel membership in the Loyalty Program or deny the use of accumulated points in cases of violation of these Terms and Conditions, abusive use, and/or fraudulent activities related to the Loyalty Program.

 

EARNING POINTS

1. Earning Points from Purchases

The Key Members Loyalty Program allows its members to accumulate points through purchases made on the website https://nude-project.com/ or in our physical stores, provided these purchases are made through its customer account (the "Eligible Purchase".

The points earned from each purchase depend on the loyalty level achieved by each Member (the "Tier"):

  • THE PENTHOUSE: Members with 0-2.500 points. Earns two points for every euro spent.
  • THE SUITE: Members with 2.501-6.000 points. Earns five points for every euro spent.
  • THE EXECUTIVE: Members with more than 6.000 points. Earns ten points for every euro spent.

Any new Members will be automatically placed at The Penthouse Tier. The Tier of the Member will automatically change depending on the number of available points.

The exact number of points to be received upon any Eligible Purchase shall be calculated considering the Member’s Tier and the total amount of the relevant purchase, including product price, VAT, and shipping costs (if so applicable). In case of decimals in this calculation, they shall be rounded down.

Purchases of gift cards shall be considered as Eligible Purchases for Loyalty Program benefits. However, purchases made using a gift card are not considered as Eligible Purchases for any point accumulation within the Loyalty Program.

Points for purchases are generated immediately but will become effective after 31 days since the relevant Eligible Purchase.

 

Other Ways to Earn Points

Addittionally, Nude Project will reward Members with points for engaging in activities as determined by Nude Project. Examples of eligible activities include:

  • Creating a customer account will grant Members X welcome points.
  • To celebrate Members’ birthdays, Nude Project will gift 400 points to customers who have included their date of birth in the provided account details.
  • Nude Project will gift 100 points to Members for following the brand on Instagram, 100 points for following on TikTok, 100 points for following on YouTube, and 100 points for subscribing to the newsletter.

Nude Project reserves its right to unilaterally and without prior notification to include, modify or eliminate any activities that allow Members to earn points or the number of points to receive for any of these.

 

INFORMATION ABOUT POINTS

Members can check their points balance by logging into their account through the website https://nude-project.com/account/login.

Members accept that Nude Project may communicate program-related information, such as promotions, offers, private sales, and any other commercial updates of interest, via mail, email, SMS, and other channel.

Additionally, these same channels may be used to notify Members about their loyalty tier, points balance updates, or relevant changes to the Loyalty Program.

For any claims regarding points balances related to online purchases, Members should contact Customer Service via email at contact@nude-project.com, providing the email address associated with their customer account and the order number of the purchase made on the website.

Any point accumulated in the Loyalty Program are valid for 12 months from the date of acquisition. After this period, the points will expire.

 

BENEFITS OF THE LOYALTY TIER

In addition to the awarding of points after each purchase through the customer account, Members can enjoy other benefits based on their loyalty Tier.

The benefits for achieveing a Tier are not granted automatically. Instead, Members within the relevant Tier will be allowed to automatically participate into a draw to access benefits when so decided by Nude Project that may include the following:

  • Visit NUDE HQ
  • Invitation to NUDE events
  • Invitation to podcast sets
  • Exclusive private events for Members
  • Drop a product with your name on it

Nude Project will notify the Members of each Tier whenever a draw is scheduled and with the applicable conditions of it.

 

REDEEMING REWARDS

Members can redeem their points to obtain the rewards offered by Nude Project through the website https://nude-project.com/account/login.

Redeemed points for rewards cannot be refunded once used.

If the Member redeems its points for a discount voucher, that voucher can just be redeemed once and just within a term of 6 months once the points are redeemed.

After using points, the Member’s points balance will be reduced by the redeemed amount of points. However, bear in mind that the following conditions will apply:

  • If a Member requests a refund for an item purchased using discount voucher obtained after redeeming points, the points used to obtain such discount will not be re-added to the account balance.
  • If a Member requests a refund for an item acquired with points, the points will only be re-added to the account balance if the refund is complete.
  • If a customer returns a purchase or receives a refund, the points earned from that purchase will automatically be deducted.
  • If a customer returns part of an order (and did not use a voucher for the order), the awarded points will be removed proportionally.

  • In physical stores, only rewards that consist of a discount voucher may be redeemed. Any other reward obtained shall be claimed through the Member profile. 

Purchases in which customers benefit from a discount obtained by redeeming points will also accumulate points under the same conditions outlined in these Terms and Conditions.

For physical rewards such as a cap or accessory, only one reward can be redeemed per purchase and per user.

Nude Project reserves the right to cancel orders in cases of improper use of these rewards.

Nude Project also reserves the right to modify, limit, remove all existing rewards in the Loyalty Program at its own discretion,. how the points are earned, the threshold to achieve any Tier and how Eligible Purchases are evaluated. Nude Project reserves its right to set limits on the number of purchases or activities that are eligible for the Loyalty Program and or for any given Tier, the number or types of rewards or benefits that Members may receive or earn in any given Tier, in a given period of time or the duration of the Loyalty Program itself. 

Neither accounts nor Points, benefits or rewards may be transferred, shared or combined. Only the member paying the products may accumulate rewards, benefits and/or points. Nude Project reserves the right to monitor the number of accounts per household and refuse, merge or close additional or duplicate accounts at any time. 

Rewards, benefits and points shall have no cash value, are non-transferable, and Members have no property rights in or to rewards or other Program benefits.

DURATION AND MODIFICATION OF THE LOYALTY PROGRAM

Nude Project reserves the right to modify or suspend the Loyalty Program at any time. The Terms and Conditions of the Loyalty Program may be modified at any time without prior notice by Nude Project, with the most current version available at https://nude-project.com/. In the event of suspension of the Program, Nude Project commits to informing Members via email sent to the addresses provided, without the obligation to justify the decision and without any compensation to the Member.

Nude Project reserves the right to exclude any Member or to discontinue its participation in the Loyalty Program and to audit Member’s membership accounts at any time and in Nude Project sole discretion. To keep an account active, the relevant Member shall log in to the Loyalty Program account and make a purchase within 24 months. Any suspected abuse of the Loyalty Program, failure to follow Terms and Conditions, inactivity for longer than 24 months, illegal activity, fraud, misrepresentation or other conduct inconsistent with these Terms and Conditions and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent other unauthorized use of any Loyalty Program rewards, points, cards, credits, vouchers, coupons and/or certificates, may result in the revocation of your membership and make you ineligible for further participation in the Loyalty Program.  If your membership is revoked, any rewards or benefits in your account will automatically expire and your access to the Loyalty Program and features will automatically terminate. If Nude Project suspects illegal activity, fraud, misrepresentation, abuse or violation of these Terms and Conditions, Nude Project also has the right to take appropriate legal action, in our sole discretion.

In case a Member decides to opt-out from the Loyalty Program, they shall send an email to help@nude-project.com with the subject “UNSUBSCRIBE LOYALTY PROGRAM” whenever it is decided. 

The cancellation will produce the loss of all accumulated points, benefits and Tier status.

 

RESPONSIBILITY

The Member is solely responsible for the use of the benefits and rewards associated with the Loyalty Program, and as such, Nude Project is exempt from any liability in this regard. In the event of discrepancies regarding the accumulated balance, the information in the Nude Project database will be considered authoritative.

Nude Project is not responsible for rewards, benefits or points lost or redeemed due to fraudulent activity by the Member or any third party. 

For avoidance of doubt, neither Nude Project nor its parent companies, subsidiaries, affiliates, partners, or licensors shall be responsible or liable (including negligence) for any of the following:

  1. Any interruption of business.

  2. Delays or interruptions in the Member’s access to the program.

  3. Failure to deliver, loss, theft, incorrect delivery, corruption, destruction, or any other modification of data.

  4. Any losses or damages incurred as a result of the Member’s interactions with third-party links on the site or the use of any rewards or benefits associated with the program.

  5. Computer viruses, system failures, or malfunctions that may occur in connection with the Member’s use of the site, including while linking to or from third-party websites.

  6. Any inaccuracies or omissions in the content related to the program.

  7. Any events beyond Nude Project’s reasonable control.

Nude Project makes no representations or warranties that any defects or errors will be corrected.

Furthermore, neither Nude Project nor its parent companies, subsidiaries, affiliates, partners, or licensors shall be liable for any indirect, special, punitive, incidental, or consequential damages (including lost profits) arising from or related to the program or the Member’s participation in it, even if Nude Project has been advised of the possibility of such damages.

If the Member is dissatisfied with the program, the sole remedy is to terminate their membership. Nude Project holds no further obligations, liabilities, or responsibilities toward the Member.

GOVERNING LAW 

Any claim arising from this Terms and Conditions or the Loyalty Program shall be interpreted according to the common Laws of Span.
